2nd Power of Attorney John Spracklin’s Estate – March 16, 1863

About a month later another Power of Attorney was created, this time in Johnson County, Iowa, by Solomon Goss Spracklin and Louisa Jane Spracklin, his wife.  This Power of Attorney was dated March 16, 1863 and Recorded March 24, 1863.

 Know all men by the presents, That we Solomon G. Spracklen and Louisa J. Spracklen his wife of Johnson County State of Iowa in consideration of the sum of one dollar in hand paid by Peter Spracklen of Benton County State of Iowa and who is about to visit the state of Ohio do by these presents hereby constitute and appoint said Peter Spracklin our true and lawful Attorney for us and in our names places and stead to bargain sell and convey to such persons as he our said Attorney may see fit and for such prices and sums of money as he may think proper, all the right title and interest of said Solomon G. Spracklen, being the interest of one seventh as one heir of John Spracklen late of Knox County in the State of Ohio, deceased and of the right of dower of said Louisa J. as the wife of said Solomon G. Spracklen in and to all and any real estate lands, testaments, or any personal property goods or [         ] in action of which the said John Spracklin died seized, or possessed, in the said county of Knox in the State of Ohio and upon [     ] bargain or sale of said real estate or personal property or any part thereof.  To execute acknowledge and deliver for us and in our names full and perfect deeds conveyances [acquisitions], releases and receipts, and to do and perform all any and every act of any kind proper or necessary to be done in & about the premises it being intended that the foregoing instrument shall authorize and empower said Peter Spracklen to do & perform everything proper or necessary to bargain sell and convey the interest of said Solomon G. Spracklen, as one of the children & heirs of said John Spracklen, deceased, in as full & perfect a manner as we & each of us could do if personally present. And we do hereby authorize and empower the said Peter Spracklen as fully as we might, if personally present, to choose constitute and appoint such persons as he may select in the county of Knox aforesaid to act for us and in our names in the absence of the said Peter Spracklen, with full power as our attorney under this instrument, we [    ] said constit      ] hereby ratifying & confirming the acts of said Peter Spracklen, as well also the acts of such person he may select and empower to act under this instrument, as may lawfully be done, in premises.  Witness our hands this 16th day of March 1863.

On this 16t day of March A.D. 1863 before me the undersigned a Justice of the Peace in & for Johnson County, aforesaid, personally came Solomon G. Spracklen and Louisa J. Spracklen his wife to me well-known to be the same persons who signed & executed the foregoing instrument, as constituents, and severally acknowledged the execution of said instrument to be their voluntary act & deed, for the purposes therein specified. And the said Louisa J. being examined separately and apart from her said husband, acknowledged said instrument to be her free act & deed without compulsion or restraint of her said husband.  Given under my hand this date aforesaid.  Morris Brown, Justice of the Peace.

Cox clerk of the District Court in and for the county of Johnson, State of Iowa do hereby certify that Morris Brown Esq. whose [      ] signature is affixed to the foregoing acknowledgement was at the time of taking such acknowledgement our acting Justice of the Peace in and for the county of Johnson, State of Iowa, duly authorized by law to take such acknowledgement and full faith and credit are due to all his affixed acts as such, and I further certify, that the foregoing instrument was executed and acknowledged in accordance with the laws of this State.  In testimony whereof, I have hereunto set my hand and affixed the seal of said court, at Iowa City, this sixteenth day of May A.D. 1863. This means that Solomon Goss Spracklin had not yet made his move from Johnson County, Iowa to Harrison County, Iowa where he would remain for the rest of his life.
