1830: Henry Keller of Knox County, Ohio and a Guardianship!

In the Knox County, Ohio, Probate records there is a guardianship that appears in the year 1830.  The name of the deceased person is Henry Keller.

Probate records are online at Family Search.  So you can go and take a look.  I was really excited to find this and then disappointed because there wasn’t much there.

There were six pieces of paper, five of the pieces of paper were almost all the same in format – FHL#2118293 Box 37 under Probate Records 1808-1832, #570.

Note: If you see an underline in the transcriptions below that means the information was handwritten.

1.  Cover page #570 Henry Keller et. al. To Bond, State of Ohio as Guardian

2.  Appointed guardian to Said Henry Keller  The same three men sign all the other similar forms.  The first signature is difficult to decipher.

The conditions of the foregoing obligations are such, that the above bound Henry Keller Elizabeth Keller has by the court of common pleas been appointed guardian to infant said Henry.  NOW said Henry Keller  shall discharge with fidelity the trust reposed in him and shall render an accurate statement of all his transactions with a just account of the profits arising or accruing from the real or personal estate of his ward, & to deliver up the same to the court when thereunto required — then in that case this obligation shall be void, otherwise to be and remain in full force and virtue in law.

3.  Appointed guardian to John Keller, minor

Know all men by these presents that we  Henry Keller, Solomon Myers and John Ewalt are held and firmly bound to the state of Ohio in the sum of one hundred dollars, and for the faithful payment and performance of which, we bind ourselves, our heirs, executors &c. scaled with our seals and dated the 26 day of October 1830

The conditions of the foregoing obligations are such, that the above bound Henry Keller has by the court of common pleas been appointed guardian to John Keller, minor infant orphan of Son of Henry Keller.  NOW said Henry Keller  shall discharge with fidelity the trust reposed in him and shall render an accurate statement of all his transactions with a just account of the profits arising or accruing from the real or personal estate of his ward, & to deliver up the same to the court when thereunto required — then in that case this obligation shall be void, otherwise to be and remain in full force and virtue in law.

4.  Appointed guardian of Jacob Keller, minor

Know all men by these presents that we  Henry Keller, Solomon Myers and John Ewalt are held and firmly bound to the state of Ohio in the sum of one hundred dollars, and for the faithful payment and performance of which, we bind ourselves, our heirs, executors &c. scaled with our seals and dated the 26 day of October 1830

The conditions of the foregoing obligations are such, that the above bound Henry Keller has by the court of common pleas been appointed guardian Jacob Keller Minor  infant orphan of  son of Henry.  NOW said Henry Keller  shall discharge with fidelity the trust reposed in him and shall render an accurate statement of all his transactions with a just account of the profits arising or accruing from the real or personal estate of his ward, & to deliver up the same to the court when thereunto required — then in that case this obligation shall be void, otherwise to be and remain in full force and virtue in law.

5.  Appointed guardian of Peter Keller, minor crossed off infant and orphan “son of Henry Keller.”

6.  Appointed guardian of Susannah Keller, minor

 Know all men by these presents that we  Henry Keller, Solomon Myers and John Ewalt are held and firmly bound to the state of Ohio in the sum of one hundred dollars, and for the faithful payment and performance of which, we bind ourselves, our heirs, executors &c. scaled with our seals and dated the 26 day of October 1830

The conditions of the foregoing obligations are such, that the above bound Henry Keller has by the court of common pleas been appointed guardian to Susannah Keller infant orphan of  minor.  NOW said Henry Keller  shall discharge with fidelity the trust reposed in him and shall render an accurate statement of all his transactions with a just account of the profits arising or accruing from the real or personal estate of his ward, & to deliver up the same to the court when thereunto required — then in that case this obligation shall be void, otherwise to be and remain in full force and virtue in law.

In looking at these documents we see that we may have a family grouping. I am not sure I am reading the above correctly.

Update: July 12, 2016. I contacted the Knox Co. Annex and asked if they would take a look at court documents.  The assistant found in the court minute books a document in which the children wanted their father Henry Keller to be their guardian. So my statement below is incorrect.

Henry Keller and Elizabeth becoming guardians of: Henry, Jacob, John, Peter, Susannah.

Here is a transcript of that court document from the minute book:

John Keller, Jacob Keller & Peter Keller Minors over the age of fourteen years, and Susanna Keller over the age of twelve years, came unto court and choose their father Henry Keller as their guardian, whencefore the court do appoint the said Henry Keller as Guardian to the said John Keller, Jacob Keller and Peter Keller & Susanna Keller. The court do  also appoint the said Henry Keller as Guardian of Elizabeth Keller a minor under the age of 12 years. It is further ordered that the said Henry Keller give separate bond in each case in the sum of one hundred dollars and Solomon Myers, & John Ewalt approved of bail. 

So based on the above, we have a father Henry Keller and his minor children:

John Keller above the age of 14 – see the census below – Our John Keller would be 20 in 1830 born in 1810.  So this means this is probably not him.

Jacob Keller above the age of 14 – see the census below

Peter Keller above the age of 14 – see the census below

Susannah Keller above the age of 12 – see the census below

Elizabeth Keller under the age of 12 – see the census below

Revisiting the 1830 Henry Keller census for Knox County.  The date of the guardianship is in October and the census was done in June of the 1830.

  • 10 to 15 – 1,  – The above court document has 3 boys above the age of 14 but minors
  • 15 to 20 – 1 –

  • 30 to 40 – 0 – Is this Henry? 
  • 50 to 60 – 0,
  • 60 to 70 – 0,
  • 70 to 80 – 0.
  • There are no other older persons beyond Henry

Females

  • under 5 – 3
  • 3 to 10 – 2 – Could be Elizabeth but there is an other child
  • 10 to 15 – 1 – Could be Susannah?
  • 15 to 20 – 0,
  • 20 to 30 – 0,
  • 30-50 – 1 – possibly Henry’s wife but maybe his mother hard to say

Summary:  I am very frustrated with this guardianship and revisited the Family Search records for Knox County probate and estates to see if I could find more.  I found the same papers. I had trouble finding them again because they don’t list the film numbers beside the titles.  See the film number above for a link.

If you look at the Family History listing for Knox County Probates online you will notice that an index for A to P is missing. They have Q to Z.  I believe it is there in the first selection which is titled:  Administration bonds and letters 1808-1928 vol. 1 (A-P).

When I visited the Family History Library in Salt Lake City, I spent a great deal of time trying to figure out the films for Knox County estates and probates and it was not easy.  I was searching for many surnames at the time and trying to find documents.  I was unable to locate any estate for Noah Goss who died in 1833.  I am saying that my concern is that the coverage for earlier documents maybe be wanting?

There must be further court records about this guardianship but at this time I do not know. It does mention the Court of Common Pleas.  Court records would be separate from the probate records and there are listings in the catalog at Family Search but they are not online at this time.  Update:  July 12, 2016 I contacted the Knox Co. Annex and they provided me with the additional court document transcribed above regarding the guardianship.

If John Keller is age 19 in 1830, he would not be included in a guardianship from my viewpoint and there is a John listed as a minor.  I am not familiar with Ohio probate laws of the time and the requirements for minors.

The names in the guardianship are similar to the names given to John and Mary Keller’s children except for Jacob.

I am having trouble fitting the children into the census for the Henry Keller of 1830 and almost believe this is another family? Perhaps there was a change in the family grouping from the taking of the census in June to the month of October but that may be a stretch on my part?  This is still a problem as of July 12, 2016.

The other interesting thing is that Henry doesn’t sign the document only the three men do: John Ewalt, Solomon Myers and ___________.  I have tried comparing each piece of paper and the signatures for the first man but the signature does not improve and, in fact, gets worse.  What relationship they have to the family is unknown at this time.

So basically I am once again stumped as to what is going on and if in fact this guardianship is even tied to the Henry Keller of the 1830 U.S. Census in Ohio or for that matter our John Keller. I can see more research is needed.

AUUGH!!! and a Second Auggh!
