John Goss and his land in Ste. Genevieve, Missouri

I was able to find some deeds for John Goss in the Ste. Genevieve records.  They are very interesting.  I do not think this is a complete picture of John’s land deals, but it is a start. These records are online at FamilySearch and I have found the index to the deeds to be difficult to follow, especially in determining the book the deeds are located in. I have found it squeezed in between deed entries and almost missed. I have actually guessed by the date of the deed what book it was in. I am learning that the records in Missouri are done differently than what I am use to, so that has been a challenge.

6th November 1856 Bk K page 431 and 432:

This deed made and entered into this Sixth day of November eighteen hundred and fifty six by one between John Goss and Elizabeth his wife of the County of Ste. Genevieve Missouri parties of the first-part and Dr. Eugene Pernot of the same County and State party of the second part Witnesseth that said parties of the first part in consideration of the sum of Fifty Dollars to them paid by the said party of the second part the receipt of which is hereby acknowledged. Do by these presents remise, release and forever quite claim unto the said party of the second part the following described lot tract or parcel of land lying and being in the County of Ste. Genevieve, State of Missouri on the Ste. Genevieve Iron Mountain & Pilot Knob Plank Road viz. Begin at the N W Corner Stone of Survey No. 272. Thence N 27 degrees & 73 Links to N. E. corner stone of survey no. 270; Thence S 851/2 degrees & 1.36 links set a post (corner for Dr. Pernot). Thence No 6 degrees west 8 chains to the Plank Road. Thence S. 73 Degrees W with the ________of the Plank Road 10 chains one ___ Links – Thence S. 80 degrees W. 10 chains; Thence N 80 degrees W 5 chains. Set a post on Goss line; Thence N 3 degrees W. 380 links to a stone corner be_____Goss & Perrport. Thence N 87 degrees E. 41 chains & 50 links to the Corner Post between G. D. Scott & Dr. Pernot. Thence 37 degrees E. 4 chains 69 Links to a post between said Scott & Pernot.  Thence S 63 degrees W 18 chains 19 links to the beginning corner said tract containing nineteen acres and Fifty three hundreds of an acre be the same more or less.

To Have and to Hold the same together with all the rights __________privileges and appurtenances to the same belonging unto the said party of the second part. ___to his heirs and assigns forever.  In witness whereof. This Deed made on the tenth day of November eighteen hundred and fifty-six by and between John Goss and Elizabeth his wife of the County of Ste. Genevieve, Missouri parties of the first part and Joseph Pothier of the same County and State party of the second part. Witnesseth: That the said parties of the first part in consideration of ten dollars to them paid by the said party of the second part the receipt of which is hereby acknowledged. To by these presents remise, release and forever Quit Claim unto the said party of the second party and to his heirs and assigns forever the following described Lot-tract-or parcel of land lying and being situate near the City of Ste. Genevieve on the Plank Road leading to the Iron mountain in the County of Ste. Genevieve viz: Begin at a stone on the north side of the Plank Road on the North____south line between Section Nos 29 & 30 in Township 38 N of R. G. Cast. Thence N 68 degrees E 4 chains to the S E corner stone. Thence North 2 chains to the N.E. corner stone. Thence N 68 degrees We. 4 chains to the N W corner. Thence south 2 chains to the beginning corner containing 80 hundreths acres.

To Have and to hold the same with all the rights, amenities, privileges and appurtenances thereunto belonging unto the said party of the second part and to his heirs and assigns forever.

Whereas I John Goss of the County of Ste. Genevieve in the State of Missouri have made claim and entry as a presenter in the Land office at St. Louis in the State of Missouri , and have obtained a certificate of Presumption dated the seventh of July one thousand Eight hundred and fifty-six for the following described tract tenement and parcel of land lying West of the City of Ste. Genevieve and adjoining the same in the County of Ste. Genevieve containing one hundred and twenty nine acres and five hundredths of an acre and described in the said certificate of entry of which the following is a copy viz): “Pre act 1841 No. 28.755 = Receiver’s office at St. Louis, MO. July 7th 1856 = Received from John Goss of Ste. Genevieve County Missouri the sum of one hundred and sixty-one dollars and thirty nine cents being in full for the fvl sec. No 29 & 30 between Surveys 269 & 270 272 & 3249 in township No. 38 of Range No. 9 East containing one hundred and twenty nine acres and five hundredths at $1.25/100 per acre” “$161.31/100 Duplicate (Signed) Rich B. Dallain Receiver.”

And thereas George G. Scott of the same county and state is possessed of holds and lays claim to certain lots and parcels of land situate on and included within the boundaries and limits of the entry and purchase so by me made and which said lots or parcels of land are situated and bounded as follows to wits: one lot or parcel of land containing about eighteen acres and fifty two hundredths of an acre. Bounded North by the Plank Road and South by Antoine Boyer and perhaps others ______. Known West by the Lands of John Goss claimed and held under his said entry and East by Lands now owned and occupied by Eugene Renod – Also one other small lot or parcel of land containing about two acres and eighteen hundredths of an acre being in a triangular form lying South of the Plank Road and Bounded North by the Toll Gate lott, and Damien Caho or Th_____West by Eugene Penod on the South by Lotts number two and three (2 & 3) in the subdivision of Survey Number two hundred and seventy two (272)confirmed to Francis More or Moreau an don the East coming to a point. The said two lots containing together the quantity of twenty acres and seventy hundredths of an acre as will more fully appear by a survey and plat made by John Lee County Surveyor of Ste. Genevieve County Which is hereto attached and made a part and parcel of this Instrument.

For this Indenture made this 29th day of October in the year one thousand Eight hundred and fifty-seven by and between John Goss and Elizabeth Goss his wife of the County of Ste. Genevieve and State of Missouri of the one (pg 358) part, and George D. Scott of the same County and State of the other part. Witnesseth, the said John and Elizabeth Goss for an in consideration of the Premises and for the purpose of quieting adjusting and finally selling amicably the conflict in regard to the aforesaid lotts and premises between the Parties and for the further consideration of the sum of twenty-five dollars them in hand paid by the said George D. Scott the receipt whereof is hereby acknowledged have remised released and forever quite claimed and by these presents the said John Goss and Elizabeth his wife do remise release and forever quite claim to the said George D. Scott all our and their right title claim Interest and property present and to come of in and to the above and before stated and described to lotts ______of said included and described as above in the said certificate of Presumption and entry and aforesaid. 

To Have and to hold to the said George D. Scott his heirs and assigned forever all our right title claim interest and property clear and free from us our heirs and assigns and all persons claiming or to claim the same by through or under us or either ____but from the claim or claims of other person or persons ________.

In Testimony whereof the said John Goss and Elizabeth Goss his wife have hereto set and subscribed their names and affixed their ____as their seals this 29th day of October in the year one thousand eight hundred and fifty seven. Be it Remembered that John Goss and Elizabeth his wife who are personally known to the undersigned Clerk of the Circuit Court for said county to be the persons whereas named and subscribed to the foregoing instrument of writing as parties thereto this day appeared before me and acknowledged that they executed and delivered the same as their voluntary act and deed for the uses and purposes therein contained. And the same Elizabeth being by me made acquainted with the contents of said deed or instrument of writing acknowledged on an examination, apart from her said husband, that she executed the same and relinquishes her down in the real estate therein mentioned, freely and without compulsion or undue influence of her said husband.

Description of a piece of land surveyed for John Goss and Antoine Bozer began at the SW corner stone for survey No. 270 thence ct. 85 1/2  degrees E with North boundary of Survey No.  270 11 chains to corner stone on said line between G.D. Scott & J. Goss thence S 77 degrees W 11 chains & 16 links set a line stone on Western boundary of said survey…Thence ct. 27 degrees W 4 chains and 22 links to beginning corner stone containing 2 ¼ acres.

Also a piece for Began at a stone on the North side of the Plank road on the Ct & S line between sections 29 and 30 in S. 38 ct. of K. 9 E. Thence Ct 68 degrees E 4 chains to the SE corner stone thence ____4 chains to the SE corner stone thence _____2 chains to the Ct. E. corner stone. This Deed made on the 18th day of December eighteen hundred and fifty-six by and between John Goss and Elizabeth, his wife, of the county of Ste. Genevieve and State of Missouri parties of the first part and Peter Thowure of the of the county of Ste. Genevieve and State of Missouri party of the second part Witnesseth:  That the said parties of the first part in consideration of Twenty Dollars to them paid by the said party of the second part the receipt of which is hereby acknowledged do by these presents, remise, release and forever quit claim unto the said party of the second part, a certain tract of land situate in the County of Ste. Genevieve and State of Missouri as described as follows to wit: being part os the fractional sections twenty-nine and thirty in township 38 of Range 9 East and commencing ____point at the Northwest corner of Survey No. 270; then S 85.5 degrees We 35.06 chains; thence south 4.44 chains to the line of Survey No. 3249; thence ___the line of said Survey No. 2249 to the point of intersection of Survey No. 270; Thence with the line of said Survey No. 270 to the place of beginning and containing 12 70/100 acres more or less.

To Have and To Hold the same with all the rights, amenities privileges, and appurtenances thereunto belonging unto the said party of the second part and his heirs and assigns forever.

Once again I suggest that you go to the BML Glo records site and do a little search.  Click on the map information after searching and you will be surprised as to the nature of the land he owned it is like a puzzle, not the usual square or rectangular piece of land. To all to whom these presents shall come Greeting Whereas John Goss of Ste. Genevieve County Missouri has deposited in the General Land Office of the United States, a certificate of the Register of the land office of St. Louis whereby it appears that full payment has been made by the said John Goss, according to the provisions of the Act of Congress of the 24th of April 1820, entitled an act making further provision for the sale of the public lands, for the fractional sections twenty nine and thirty between surveys two hundred and sixty nine, two hundred and seventy two hundred and seventy two, and three thousand two hundred and forty nine in township Thirty eight north of Range Nine East in the District of Lands subject to sale t St. Louis, Missouri containing one hundred and twenty nine acres and five hundredth of an acre according to the official plat of the Survey of the said Lands returned to the General Land office by the Surveyor General, which said, tract has been purchased by the said John Goss.

Now Know ye, that the United States of American in consideration of the promises, and in conformity with the several acts of Congress in such case made and entered provided. Have given and Granted and by these presents do give and grant unto the said John Goss, and to his heirs the said tract above described. To Have and to hold the same, together with all the rights privileges, amenities and appurtenances, of whatsoever nature thereunto belonging unto the said John Goss and to his heirs and assigns forever:

Witnesseth that the said parties of the first, in consideration of the sum of one thousand dollars to them paid by the said party of the Second part, the following land lying on the Plank Road about two miles west of the city of Ste. Genevieve in the County of Ste. Genevieve and State of Missouri – to say all the rest and residue not heretofore sold of the land purchased from Joseph Thomure, as per Book H, pages 395 and 396, also all the rest and residue (not heretofore sold) of the land I hold under United States Patent #28755 dated in the City of Washington the first day of October, one thousand eight hundred and sixty – which Patent embraces land in fractional Sections 29 and 30 between surveys No. 269.270.272 and 3249 in Township 38 North Range 9 East in the district of Lands subject to sale at St. Louis, Missouri and reference being hereunto made to said patent (and after reserving and deducting those sold as above referred to) the residue of said lands now sold is suppose to be about Sixty acres be the same more or less.

This deed made and entered into this Twenty Seventh day of January eighteen hundred and Sixty four by and between John Goss and Betsy Goss his wife of the County of Ste. Genevieve and State of Missouri part of the first part and Joseph Porthier of the same County and State party of the Second part.  Witnesseth: That the said parties of the first part in consideration of the sum of five dollars to them paid by the said party of the Second part the receipt of which is hereby, acknowledged do by these presents, remise and release and forever quite claim unto the said party of the second part Two small tracts or parcels of Land lying near or adjoining the Plank Road and about two miles west of the City of Ste. Genevieve, to say, first, a small fraction of Land lying and being on the South side of Plank Road and bounded South and West by Land of Peter Thomure, beginning at a point on said Plank Road and turning East or SouthEast about Sixty fee north the line of said Peter Thomure to where it coners with Land of Antoine Boyer, and thence from said corner of Boyer & Thomure in a northerly direction to the Plank road which line if extended across said Plank Road would meet the South East corner of Land, owned by said party of second part thence in a westward direction to place of beginning containing about one Eighth of an acres – Second, another small Lot fraction of Land lying on the West side said Plant Road, beginning at West corner of Land of said party of second part thence running North west said line about twenty fee North west corner of said Porthier’s line and Thence west being a prolonation of said Portheir East and west line to intersect Peter Thomure’s line and thence East south East with said Thomure’s line to place of beginning to containing about one eight of an acre and the two fractions or parcels of Land hereby sold contain together about one four of an acre be same more or less.

Well, we see how John Goss obtained his land and how complicated it all was. Apparently there was some difficulty in getting it all settled. Again, I do not see this as a complete picture of John Goss’s land dealings. I cannot tell if he sold it all or what is going on.  Cousins believe he did sell a house to the Bogy family but I don’t see any names like that here, but it might be held in a different book if it was a house.

I have tried to find deeds for John Goss and land in Michigan (I think he was gone by 1835 to Missouri?), Illinois (need a location) and Kansas but it is not all online. So there is a lot more to do regarding John and his land.  I found the index for land in Missouri very difficult to interpret and I am not sure it was all complete. I did not find any partition deeds with his sons, which is a puzzle?
